Information on the use of your personal data
Volkswagen Immobilien offers comprehensive real estate services in which personal data are processed. Volkswagen Immobilien GmbH, Poststr. 28, 38440 Wolfsburg, Germany (“VWI”) is the data controller within the meaning of Article 4 Paragraph 7 of the European Union General Data Protection Regulation (GDPR) for all personal data that arises in connection with the use of our services.
Processing personal data at Volkswagen Immobilien means that we collect, record, use, match, delete or destroy such data (Art. 4 Para. 2 GDPR).
We need your personal data to fulfil our tasks. This includes, among other things, renting out, brokering and selling residential space, making rent payments, issuing permits and statements of account, as well as commissioning tradesmen to repair damage to the flat or building. This also includes the renting of business flats in SPLACE.
We process the following personal data for this purpose:
- First name and surname, address, date of birth, email address, telephone number
- Gender
- Employer, personnel number (in case of renting to employees of Volkswagen AG)
- Bank details and SEPA information
We collect your personal data primarily from you through the online form on our website and when drawing up the rental contract. The legal basis for this is Article 6 Paragraph 1 b) and f) of the GDPR. In enforcement proceedings, we may collect data from third-party debtors (e.g. credit institution, public offices or employer).
Your personal data is stored and processed in our IT landscape at Volkswagen Immobilien. We use technical and organisational security measures to protect your personal data against accidental or unlawful destruction, loss or alteration and against unauthorised disclosure or access. Our security standards are state-of-the-art.
We may only pass on any personal data that has become known to us to other persons or bodies (e.g. authorities, SCHUFA) if you have consented to this or if the passing on is permitted by law.
We pass on your personal contact details (telephone number and email address), e.g. in the event of reported damage, to our contracted tradesmen so that they can arrange appointments for repairs, etc. directly with you. If you do not agree to the forwarding of contact details, please inform us of this when concluding the rental contract. In this case, the entire coordination of appointments is your responsibility.
In order for you to use the digital services offered at SPLACE, we pass on data to our contractual partners. These are: number of the rented flat, start and end of the rental period, first name, surname and email address. We have concluded order processing contracts with all contractual partners. The legal basis of the transfer is Article 6 Paragraph 1 b). The network and internet services are provided by WOBCOM GmbH, Heßlinger Str. 1‒5, 38440 Wolfsburg, Germany. For the service box, we use services of our partner Erwin Renz Metallwarenfabrik GmbH & Co. KG, Boschstr. 3, 71737 Kirchberg/Murr, Germany.
In the event of eviction proceedings, we will hand over your personal data to our solicitor.
We store personal data from contracts on the basis of the tax limitation periods (Section 147 of the German Fiscal Code and Section 257 of the German Commercial Code) for ten years after termination of the contract. We delete prospective tenant data when you have either concluded a tenancy agreement with us or you inform us that you do not want us to continue searching for you, provided that there are no further statutory retention periods against this.
You have various rights under the GDPR. Details can be found in particular in Articles 15 to 18 and 21.
- Right of access
You can request information about your personal data processed by us. In your request for information, you should specify your request in order to make it easier for us to compile the necessary data.
- Right to rectification
If the information concerning you is not (or is no longer) accurate, you may request that it be corrected. If your data is incomplete, you can request that it be completed.
- Right to erasure
You can request the deletion of your personal data. Your right to erasure depends, among other things, on whether the data concerning you is still needed by us to fulfil our legal duties.
- Right to object
You have the right to object to the processing of data relating to you at any time on grounds relating to your particular situation. However, we cannot comply with this if there is an overriding public interest in the processing or a legal provision obliges us to process it.
- Right to lodge a complaint
If you believe that we have not complied with your request or have not complied with it in full, you can lodge a complaint with the competent data protection supervisory authority in the state of Lower Saxony.
We will generally respond to you within one month of receiving your request. If we need more than one month for a final clarification, you will receive an interim message.
